Single User Licence Agreement
Please read this licence agreement carefully before using
the material.
By using the ampatico material you are agreeing
to be bound by the terms of this licence.
If you do NOT agree to the terms of this licence, do not use
the ampatico material.
1. General
The ampatico material is licenced to you by
Applied Mediation Ltd (AM) for your use only under the terms
of this licence and AM reserves all rights not expressly granted
to you. The right granted herein are limited to AM’s and
do not include other patents or other intellectual property rights.
You own the media on which the material is recorded, but AM retain
ownership of the material itself.
2. Permitted licence uses and restrictions
This licence allows you to install and use one copy of the ampatico material
on a single computer at any one time. This licence does not allow the ampatico material
to exist on more than one computer at a time, and you may make one copy of the ampatico material
in a machine readable form for back up purposes only; provided that the back
up copy includes all copyright and licence information contained within the original.
3. Transfer
You may not rent, lease, lend, distribute or sub-licence the ampatico material.
You may not transfer your licence rights to another party. Notwithstanding other
sections of this licence, AM labelled material provided to you on a promotional
basis may only be used for demonstration, testing and evaluation purposes, and
may not be re-sold or transferred.
4. Termination
The licence is effective until terminated. Your right under this licence will
terminate automatically, without notice from AM if you fail to comply with any
term(s) of the licence. Upon termination of this licence, you will cease to use
all of the ampatico material and destroy all copies, full or
partial, of the ampatico material.
5. Limited warranty on media
AM warrants the media on which the ampatico material
is recorded and delivered by AM to be free of defects in materials
and workmanship under normal use for a period of fourteen (14)
days from the day after you have taken delivery. Your exclusive
remedy under this section shall be, at AM’s option,
a refund of the purchase price of the material or a replacement
of the material upon return to AM the original material with
a copy of the sales invoice.
6. Disclaimer of warranties
You expressly acknowledge and agree that the use of the ampatico material
is at your sole risk and that the entire risk to satisfactory
quality, performance, accuracy and effort is with you. Except
for the limited warranty on media (set forth in 5) and to the
maximum extent permitted by applicable law, the AM material is
provided ‘as is’, with all faults and without warranty
of any kind.
AM hereby disclaim all warranties and conditions with respect to the ampatico software,
either express, implied or statutory, including, but not limited to, the implied
warranties and /; or conditions of merchantability, of satisfactory quality,
of fitness for a particular purpose, of accuracy and non-infringement of third-party
rights.
The AM material automatically references and links to sites and information located
worldwide throughout the Internet. Because AM have no control over such sites
and information, AM makes no guarantees as to such sites and information, including
the accuracy, quality and content of any such sites and information.
7. Limitation of liability
To the extent, not prohibited by law, in no event shall AM be liable for personal
injury, or any incidental, special, indirect or consequential damages whatsoever,
including, without limitation, damages for loss of profits, loss of data, business
interruption or any other commercial damages or losses, arising out of, or related
to, the use or inability to use the AM material.
The AM material has been created utilising third party software. Acknowledgements,
licencing terms and disclaimers for such material is governed by their respective
terms.
